Overview

MartyAI provides a retail technology platform that captures and interprets shopping context across in-store and digital touchpoints to help participating retailers support personalized experiences, insights, and more relevant customer journeys.

This Privacy Policy explains how MartyAI collects, uses, shares, and protects personal data when individuals interact with MartyAI through participating retailers.

1. Scope and Role of MartyAI

MartyAI provides a technology platform that enables participating retailers to capture and use in-store and assisted-selling context to support customer experiences across online and offline channels.

When processing personal data in connection with a retail experience, MartyAI acts as a service provider or processor on behalf of the applicable retailer, in accordance with the retailer’s instructions, applicable agreements, this Privacy Policy, and applicable law.

Retailers are responsible for their own privacy practices and for providing any required notices to their customers regarding their use of the MartyAI platform.

2. Information We Collect

Depending on how you interact with a participating retailer, MartyAI may process the following categories of information:

  • Shopping and interaction data, such as products considered, tried, liked, disliked, or deferred during an in-store or assisted-selling interaction

  • Preference and contextual feedback, including fit, style, fabric, use-case, and similar qualitative inputs

  • Contact information, such as an email address, if you choose to provide it

  • Technical and usage data, such as timestamps, device or session identifiers, and similar information generated through use of the platform
     

We do not require you to create a MartyAI account to participate in a retailer-powered experience unless and until such functionality is offered and explicitly opted into.

3. How We Use Information

MartyAI processes personal data for the following purposes:

  • To support personalized shopping experiences and in-store interactions, and, where enabled by a participating retailer and subject to applicable consent, to support follow-up communications or personalized experiences related to such interactions, conducted by or on behalf of the retailer through which the data was collected.

  • To enable the relevant retailer to understand customer interests and preferences and to improve its products, services, merchandising, and customer experience.

  • To operate, maintain, secure, and improve the MartyAI platform, including through the creation and use of aggregated, de-identified, or anonymized data for analytics, insights, benchmarking, and algorithmic development across the platform.

  • To comply with applicable laws, regulations, and legal obligations, and to enforce applicable agreements.

MartyAI does not initiate marketing communications to individuals except where expressly enabled by a participating retailer and subject to applicable consent.

4. Platform Learning, Contextual Signals and Aggregated Data

MartyAI may generate and use aggregated, de-identified, or anonymized data derived from interactions on the platform to improve system performance, develop new features, and enhance recommendation and attribution capabilities.

Such data:

  • does not identify any individual

  • does not identify any specific retailer

  • is not shared in a manner that would disclose another retailer’s proprietary or customer information
     

This platform-level learning enables improvements across deployments while preserving retailer and customer confidentiality.

5. Sharing of Information

MartyAI shares personal data only as follows:

  • With the retailer through which the data was collected, in accordance with the retailer’s instructions

  • With service providers and infrastructure partners acting on our behalf to support hosting, security, analytics, and platform operations, subject to confidentiality and data protection obligations

  • As required by law, regulation, or legal process
     

MartyAI does not sell personal information.

6. User-Directed Access and Portability

Where permitted by applicable law, individuals may request access to, correction of, or deletion of personal data processed by MartyAI by contacting the retailer or by emailing [privacy@getmartyai.com].

In addition, where expressly enabled in the future and subject to additional disclosures and consent mechanisms, individuals may, at their direction, access, export, or apply their MartyAI context across participating retailers or third-party tools.

7. Data Security

MartyAI implements commercially reasonable administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, disclosure, alteration, or destruction, consistent with industry standards appropriate to the nature and stage of the services.

8. Data Retention

MartyAI retains personal data only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law or applicable agreement. Upon deletion or expiration, personal data will be removed or anonymized such that it can no longer be associated with an identifiable individual. Aggregated, de-identified, or anonymized data, including preference signals and contextual representations that do not identify any individual, may be retained and used across the MartyAI platform for analytics, benchmarking, recommendation modeling, and platform improvement purposes.

9. International Processing

Personal data may be processed in the United States or other jurisdictions where MartyAI or its service providers operate, subject to appropriate safeguards as required by applicable law.
